Procedure - Urgent Business

It was RESOLVED to note that the Chairman in exercise of his powers under Section 100B(4)(b) of the Local Government Act 1972 was of the opinion that the matters referred to in Minutes C306, C331 and 332 below were for the attention of the Cabinet in view of the need to take an urgent decision.

Diweddariad ar y Cynllun Datblygu Unedol (CDU)

Dywedodd y Pen Swyddog Cynllunio (Cynllunio at y Dyfodol) fod drafftiau wedi dod o ddwy ran o adroddiad yr Arolygydd Cynllunio a bod y drydedd ran sef yr un olaf heb ddod eto. Tybir y bydd yr adroddiad llawn a therfynol ar gael yn y Flwyddyn Newydd. Cyfeiriodd hefyd at y broses a fydd yn arwain at fabwysiadu’r CDU erbyn 21 Gorffennaf 2006 a’r angen i’r Cabinet ystyried adroddiad yr arolygydd cyn gynted ag y bo modd.

PENDERFYNIAD

Nodi

(i) y dylid cyflwyno adroddiad yn ymateb i argymhellion yr Archwilwyr ynglŷn â’r CDU i’r Cabinet ar 10 Ionawr 2006; a

(ii) bod y Cabinet yn llongyfarch y Swyddogion ar eu cynnydd a’r gwaith a cyflawnwyd er mwyn bwrw ‘mlaen â hyn.

Rheswm dros y penderyfniad:- er mwyn cwrw ‘mlaen â mabwysiadu’r CDU.

Unitary Development Plan (UDP) Update

The Principal Planning Officer (Forward Planning) reported that drafts of two sections of the Planning Inspectors’ report had been received and that the third and final part was still awaited. It was envisaged that the full and final report would be available in the New Year. He also advised members of the process leading to the adoption of the UDP by July 21 2006 and of the need for Cabinet to consider the contents of the inspectors’ report as early as possible.

DECISION

To note

(i) that a report responding to the Inspectors’ recommendations on the UDP would be made to Cabinet on 10 January 2006; and

(ii) the Cabinet’s congratulations to Officers on their progress and the work accomplished in order to move ahead.

Reason for decision:- in order to progress the UDP towards adoption.

Adroddiad Archwilio mewnol Drafft ar Y Crwner

Ystyriwyd Adroddiad y Prif Weithredwr ynglŷn ag Adroddiad Archwilio mewnol yn rhoi gwybodaeth am Swyddfa’r Crwner.

PENDERFYNIAD

(i) nodi cynnwys yr Adroddiad Mewnol; a

(ii) chymeradwyo’r argymhellion fel y rhestrir yn Atodiad 1V yr adroddiad.

Rheswm dros y penderfyniad:- sicrhau y ceir gweithdrefnau a phrosesau cywir ac y cyflwynir gwelliannau.

Draft Internal Audit Report on the Coroner

Consideration was given to the Report of the Chief Executive upon the Internal Audit Report providing information regarding the Coroner’s Office.

DECISION

(i) to note the content of the Internal Audit report; and

(ii) to approve the recommendations as listed in Appendix 1V of the report.

Reason for decision:- to ensure proper procedures and processes are undertaken and improvements made.

Highways, Property and Works Departmental reports

Consideration was given to the Report of the Director of Highways, Property and Works upon the following matters in Minutes C309 to C313 below

Gwahardd aros ar unrhyw adeg – Arfaethedig – ochr de-orllewinol Coedlan y Parc, Aberystwyth

PENDERFYNIAD

Y dylid cyhoeddi’r Gorchymyn Rheoli Traffig drafft angenrheidiol a chyflwyno’r Gorchymyn, ar yr amod na dderbynnir gwrthwynebiadau.

Rheswm dros y penderfyniad:- ategu at y datblygiad sy’n digwydd ar ochr ogledd-ddwyreiniol Coedlan y Parc.

Proposed Prohibition of Waiting at any time – south western side of Park Avenue, Aberystwyth

DECISION

That the necessary draft Traffic Regulation Order be published and, subject to no objections being received, the Order be introduced.

Reason for decision:- to complement the development taking place on the north eastern side of Park Avenue.

Ategu’r gwiriad canlynol at God Ymarfer Archwiliad o Ddiogelwch Ffyrdd Sirol Cyngor Sir Ceredigion:_

Fel arfer, cynhelir archwiliadau diogelwch ar gyfnodau penodol a amlinellir yn Adran 9 ond mae’n bosib y caiff y rhaglen archwilio ei gohirio yn ystod Gwyliau Statudol ac yn ystod cyfnodau o dywydd eithriadol, megis llifogydd neu eira pan na fydd archwiliad go iawn o’r rhwydwaith ffyrdd yn bosibl. Pan gaiff archwiliadau eu gohirio am gyfnodau o 2 ddiwrnod neu lai, caiff y ffyrdd a’r troedffyrdd a oedd fod i gael eu harchwilio ar y diwrnodau hyn eu harchwilio o fewn pythefnos o’r dyddiad y bydd yr archwiliadau’n ailgychwyn. Pan fydd cyfnod y gohirio’n hwy na 2 ddiwrnod, bydd y rhaglen archwilio'n cael ei symud ymlaen/ailosod ac yn ailgychwyn fel pe na bai’r cyfnod gohirio wedi bod, a hynny gyda chymeradwyaeth Cyfarwyddwr y Priffyrdd, Eiddo a Gwaith mewn ymgynghoriad â’r Aelod Cabinet. Lle rhoddir caniatâd i symud y rhaglen archwilio ymlae , bydd yn rhaid nodi’r rheswm a hyd y gohirio ar y system reoli Mayrise.

Rheswm dros y penderfyniad:- cyflwyno rhagor o hyblygrwydd i’r Cod Ymarfer.

Safety Inspection of County Roads

DECISION

That the following wording is added to the “Ceredigion County Council Inspection of County Roads Code of Practice:_

Safety Inspections shall normally be carried out at the fixed intervals set out in Section 9 but the programme of inspections may be suspended on Statutory Holidays and during periods of exceptional weather such as flooding or snow when a proper inspection of the road network is not possible. Where inspections are suspended for periods of 2 days or less then the roads and footways which were due to be inspected on these days shall be inspected within 2 weeks of the date that inspections resume. Where the period of suspension exceeds 2 days then, with the approval of the Director of Highways, Property & Works in consultation with the Cabinet Member, the whole inspection programme shall be rolled forward/reset and resumed as if the period of suspension had not happened. Where approval is given to roll forward the inspection programme the reasons for and duration of the suspension must be logged on the Mayrise management system.

Reason for decision:- to introduce more flexibility into the Code of Practice.

• Costau gwasanaethau’r gaeaf adolygedig yn graeanu ymlaen llaw rhag ofn, a hynny ar bob llwybr sydd â sgôr o gyn lleied â -7 ar y matrics asesu
• Y dylai pob llwybr traffod ysgolion gael eu cynnwys yn y fath gyfundrefn; a

(ii) pharhau ar hyn o bryd â’r sefyllfa bresennol hyd nes y daw rhagor o wybodaeth i law.

Rheswm dros y penderfyniad:- er mwyn darparu matrics sydd wedi ei gynllunio i ddiwallu anghenion y Sir ac yn dilyn canllawiau newydd Llywodraeth Cynulliad Cymru.

Winter Service Review 2005

DECISION

(i) to request a further report early in the New Year, illustrating:-

• Costs of a revised winter service providing precautionary pre-salting on all routes scoring down to –7 on the assessment matrix
• that all school transport routes would be included in such a regime; and

(ii) continue currently with the status quo until further information received.

Reason for decision:- in order to provide a matrix tailored to suit the County’s needs and following new WAG guidelines.

Datblygu Rheoli Gwastraff

PENDERFYNIAD

Cymeradwyo’r canlynol:

(i) nodi Hysbysiad OJEC ar gyfer trefniant tymor hir

(ii) parhau â datblygu’r pecyn tymor hir;

(iii) cynnal trafodaethau i ymestyn contract y safleoedd amwynder dinesig cyfredol i 2008;

(iv) ymestyn y system casglu ymyl ffordd i’r ardaloedd hynny a nodir yn 4.1 yr adroddiad;

(v) newidiadau i’r trefniadau ar Reoli Gwastraff

(vi) ailgylchu am ddim i ysgolion o fewn yr ardaloedd casglu ymyl ffordd; a

(vii) nodi, pan roddir ystyriaeth lawn i’r ddau, y caiff adroddiad pellach ei gyflwyno i’r Cabinet ar Adroddiad drafft Adolygiad gan Gymheiriaid a dderbyniwyd oddi wrth Gymdeithas Llywodraeth Leol Cymru yn ogystal â’r llythyr diweddar iawn a’r papurau a dderbyniwyd oddi wrth Gyngor Gweithredu Gwrifoddol Cymru.

Rheswm dros y penderfyniad: - er mwyn datblygu ymhellach Strategaeth Rheoli Gwastraff yr Awdurdod.

Waste Management Development

DECISION

To approve the following:-

(i) place an OJEC Notice for long term arrangement;

(ii) continue development of the long term package;

(iii) negotiations to extend the current CA sites contracts to 2008;

(iv) the roll out of kerbside recycling expansion to the areas identified in 4.1 to the report;

(v) changes to Trade Waste arrangements;

(vi) free recycling for schools within the kerbside collection areas; and

(vii) to note that, once full consideration had been given to both, a further report would be presented to Cabinet on the draft Peer Review Report received from the WLGA together with the very recent letter and enclosures received from the WCVA

Reason for decision:- in order to progress further with the Authority’s Waste Management Strategy.

Department of Highways, Property and Works Reports for Information

It was RESOLVED to note the following reports of the Director of Highways, Property and Works for information:-

1. Care Standards Work at Hafan Deg Residential Home, Lampeter.

2. Tenders accepted under/over £50,000.

Sylfaen Treth y Cyngor a Dyddiadau Talu’r Praesept Arfaethedig

Ystyriwyd Adroddiad y Cyfarwyddwr Cyllid yn darparu gwybodaeth ar gyfer penderfynu ar Sylfaen Treth y Cyngor a Dyddiadau Talu’r Praesept ar gyfer blwyddyn ariannol 2006/07.

PENDERFYNIAD

(i) cymeradwyo Sylfaen Treth y Cyngor fel yr amlinellwyd yn Atodiadau’r Adroddiad; a

(ii) chymeradwyo’r atodlen arfaethedig o randaliadau fel yr argymhellwyd o dan eitem 4 yr Adroddiad.

Rheswm dros y penderfyniad:- er mwyn parhau i osod Sylfaen Treth y Cyngor 2006/07.

Council Tax Base and Proposed Precept Payment Dates

Consideration was given to the report of the Director of Finance providing information for determining the Council Tax Base and Precept Payment Dates for the 2006/07 financial year.

DECISION

(i) to approve the Council Tax Base as outlined in the Appendices to the Report; and

(ii) to approve the proposed schedule of instalments as recommended under item 4 of the Report.

Reason for decision:- in order to proceed to set the Council Tax Base for 2006/07.

Trosglwyddiad Ariannol yn y Gyllideb

Ystyriwyd adroddiad y Cyfarwyddwr Cyllid yn darparu gwybodaeth ar gynllun o drosglwyddiad ariannol yn y Gyllideb i gynnwys y gweithdrefnau a’r rheoliadau ariannol arfaethdig newydd.

PENDERFYNIAD

(i) nodi cynnwys yr adroddiad; a

(ii) chyflwyno’r uchafswm canlynol ar y trosglwyddiad ariannol o fewn y rheolau gweithdrefnau ariannol newydd:-

Budget Virement

Consideration was given to the report of the Director of Finance providing information of a scheme of budget Virement to incorporate into the new proposed financial regulations and procedures.

DECISION

(i) to note the content of the report; and

(ii) to apply the following Virement limit within the new proposed financial procedure rules:-

Director in agreement with Portfolio Member:- up to £150,000

Cabinet approval:- £150,001-£250,000

Council approval:- over £250,000

Reason for decision:- to amend outdated limits of Virement.

Polisi Diogeledd Gwybodaeth Drafft

Ystyriwyd Adroddiad y Cyfarwyddwr Priffyrdd ar y newidiadau arfaethedig i’r Polisi Diogeledd Gwybodaeth.

PENDERFYNIAD

(i) argymell cymeradwyo mabwysiadu Polisi Diogeledd Gwybodaeth diwygiedig y Cyngor;

(ii) dirprwyo awdurdod i’r Cyfarwyddwr Cyllid fel y gall gymryd y camau angenrheidiol i weithredu Polisi er mwyn cydymffurfio â safonau diogeledd (gan gynnwys BS7799 ac ISO17799) ac unrhyw brotocolau rhannu gwybodaeth eraill; a

(iii) nodi y bydd angen diwygio’r Polisi yn rheolaidd er mwyn sicrhau y caiff ei ddiweddaru i gydymffurfio ag unrhyw ofynion newydd.

Rheswm dros y penderfyniad:- er mwyn darparu Polisi Diogeledd Gwybodaeth priodol a chryf.

Draft Information Security Policy

Consideration was given to the report of the Director of Finance upon the proposed changes to the Information Security Policy.

DECISION

(i) to recommend approval of the revised Information Security Policy to Council for adoption;

(ii) to delegate authority to the Director of Finance to take the necessary action to implement the Policy in order to conform to security standards (including BS7799 and ISO17799) and any data sharing protocols; and

(iii) to note that the Policy will require regular review in order to keep up to date with any new requirements.

Reason for decision:- in order to provide a robust and acceptable Information Security Policy.

Training Awards Ceremony

Consideration was given to the Report of the Director of Social Services updating Members in relation to recent qualifications attained by staff and details of the Training Awards Ceremony.

Protection of Vulnerable Adults from Abuse – Annual Report 2004/05

Consideration was given to the Report of the Director of Social Services upon the activity, policy development and new legislation as contained in the Protection of Vulnerable Adults from Abuse Annual Report 2004/05 and the requirements for the future of the service in line with the WAG’s “In Safe Hands”.

DECISION

To note the content of the Report and the need to commit additional resources to this area of work.

Reason for decision:- to comply with the requirements of the WAG document “In Safe Hands”

Cynllun Troseddau Ieuenctid Gwasanaethau Cyfiawnder Ieuenctid Ceredigion 2005/06

PENDERFYNWYD nodi Adroddiad Cyfarwyddwr y Gwasanaethau Cymdeithasol yn cyflwyno Cynllun Tîm Troseddau Ieuenctid 2005/06.

Ceredigion Youth Justice Services Youth Offending Plan 2005/06

It was RESOLVED to note the Report of the Director of Social Services presenting the Ceredigion 2005/06 Youth Offending Team Plan.

Grantiau Tai

Ystyriwyd Adroddiad Cyfarwyddwr y Gwasanaethau Amgylcheddol a Thai yn diweddaru Aelodau mewn perthynas â Chyfarfod y Panel Grantiau Tai a gynhaliwyd ar 15 Tachwedd 2005.

PENDERFYNIAD

(i) nodi cynnwys y Cofnodion;

(ii) cymeradwyo argymhellion y Panel fel yr amlinellwyd yn y Cofnodion;

(iii) argymell i’r Cyngor y dylid diwygio’r polisi grantiau er mwyn adlewyrchu’r sefyllfa ddeddfwriaethol a adolygwyd sy’n berthnasol i’r broses o brofi modd ceisiadau am Grantiau Cyfleusterau’r Anabl ac na ddylid cael proses o brofi modd ar gyfer rhieni plant anabl wrth ddelio gyda cheisiadau ar gyfer grantiau ychwanegol dewisol ar gyfer gwaith addasu, a

(iv) nodi y byddai’r Cabinet yn derbyn adroddiad pellach yn ymwneud â’r cynnig ar gyfer cynllun Adnewyddu Grŵp yn Rhes Cambria, Y Borth, a fydd y cynnwys y sefyllfa gyfreithiol.

Rheswm dros y penderfyniad:- hyrwyddo gweithrediad llyfn Polisi Adnewyddu Sector Breifat y Cyngor.

Housing Grants

Consideration was given to the Report of the Director of Environmental Services and Housing updating Members in relation to the Meeting of the Housing Grants Panel held on 15 November 2005.

DECISION

(i) to note the content of the Minutes;

(ii) to approve the recommendations of the Panel as outlined in the Minutes;

(iii) to recommend to Council that the grant policy be amended to reflect the revised legislative position applicable to the means testing of Disabled Facilities Grants applicants and that no means testing be applied to the parents of disabled children when dealing with applications for discretionary top-up grants for adaptations; and

(iv) to note that Cabinet would receive a further reporting relation to the proposal for a Group Repair scheme for Cambrian Terrace, Borth which will include the legal position.

Reason for decision:- to facilitate the smooth operation of the Council’s Private Sector Renewal Policy.

Cynllun Busnes Cyfrif Refeniw Tai a Safonau Ansawdd Cymru

Ystyriwyd Adroddiad Cyfarwyddwr y Gwasanaethau Amgylcheddol a Thai yn diweddaru Aelodau ynglŷn â’r cynnydd a wnaethpwyd yn sefydlu Cynllun Busnes Cyfrif Refeniw Tai, a fyddai’n sicrhau bod yr awdurdod tai lleol yn sefydlu ei weledigaeth am ddyfodol stoc dai sydd yn perthyn i’r Cyngor.

PENDERFYNIAD

HRA Business Plan and Welsh Quality Standards

Consideration was given to the Report of the Director of Environmental Services and Housing updating Member in relation to the progress being made in establishing a Housing Revenue Account Business Plan , which would effectively ensure that the local housing authority establishes its vision of the future of the Council owned housing stock.

DECISION

(i) to note the content of the report and that a presentation on homelessness would be made to Cabinet on 24 January 2005;

(ii) that he Council reviews its existing HRA Business Plan and undertakes a full appraisal of all options available to secure the required improvements to its housing stock;

(iii) that an allocation of up to £20,000 be made from the Council’s Corporate Contingency budget, as agreed by the Director of Finance, towards the cost of undertaking the review and options appraisal;

(iv) that a project team be established to oversee and manage this work; and

(v) that the Cabinet expresses its continued intention to work closely with tenants and other stakeholders when undertaking the review and appraisal and to request officers to report further on this matter to the next meeting of Cabinet.

Reason for decision:- to enable the Council to evaluate all options available to secure the required improvements to its housing stock and thereby ensure its tenants enjoy the best possible living conditions and quality of life.

Tregaron Regeneration Strategy

Consideration was given to the Report of the Director of Corporate and Legal Services upon the Tregaron Regeneration Strategy prepared by Hyder Consulting.

DECISION

(i) to adopt the Tregaron Regeneration Strategy as the basis for capital investment projects and future regeneration schemes; and

(ii) to congratulate the Assistant Director, Mr. Allan Lewis on the work achieved in obtaining the grant.

Reason for decision:- to enable adoption of Strategy in order to progress with the regeneration of Tregaron.

Restructuring of the Flood Defence Committees in Wales The Chief Executive reported that a message had been received from the WLGA in relation to progress made on the Restructuring of the Flood Defence Committees in Wales and that WAG had agreed to increase Local Government representation from 6 to 8 representatives and that Ceredigion would be included in a region comprising Carmarthenshire and Pembrokeshire. Response were requested by 6 January 2006.

Following discussion it was RESOLVED to respond to the WLGA that, in view of the area covered by the Region containing Ceredigion, Carmarthenshire and Pembrokeshire in contrast to other Authority regions e.g. Merthyr Tydfil and Rondda Cynnon Taf, 10 Local Government representatives on the Flood Committee in Wales would be more appropriate to provide additional members for widespread rural areas.

Former Mart Premises, Lampeter

Consideration was given to the Report of the Director of Highways, Property and Works updating Members in relation to the situation at the former mart premises in Lampeter.

DECISION

(i) to confirm the sale of the former Mart site in Lampeter to the WDA;

(ii) to give urgent consideration to the provision of relocation for the Social Services Equipment Stores; and

(iii) to offer the additional land to the north of the mart site for sale on the open market subject to terms and retaining access across it.

Reason for decision:- in order to best maximise on the sale of the site.
