Dywedodd Yr Arweinydd ei fod yn teimlo cyn y gellir gweithredu unrhyw newidiadau i’r polisi ar Dai Fforddadwy dylai’r Cabinet a’r Cyngor gael y cyfle i ystyriedyr uymatebion i’r ymgynhoriad. Roedd y Cynghorydd Harris yn cytuno fod rhywfaint o ddryswch wedi codi ac y dylai’r polisi cyfredol barhau mewn lle hyd nes y bydd yr holl ymgynghoriadau ar y CDU wedi dod i ben. Cytunodd Cyfarwyddwr y Gwasanaethau Amgylcheddol a Thai y byddai’r Cabinet yn derbyn adroddiad ar yr ymatebion i’r ymgynghoriad ond byddai angen i hyn ddigwydd cyn yr Ymgynghoriad Cyhoeddus a gynhaliwyd ym mis Ionawr.

Minute C166 – Job Centre Plus

It was RESOLVED to forward a letter to Job Centre Plus outlining Members’ concerns in relation to the impending situation.

Minute C175 – Change Management

Councillor R.E. Thomas reported that the conference held on 11 November 2004 had been very successful, being well attended and of a high standard.

Minute 179 – Ceredigion Housing Needs Assessment

Councillor R.G. Harris reported that a Housing Needs Assessment Seminar for all Councillors will be held on 29 November 2004. The Leader stated that he felt that before any changes to the policy in relation to Affordable Housing was implemented, the Cabinet and Council should have an opportunity to consider the responses to the consultation. Councillor Harris agreed that some confusion had arisen and that the current Policy should remain in place until all consultations in relation to the UDP had been concluded The Director of Environmental Services and Housing agreed that Cabinet would receive a report on the responses to the consultation but this would need to take place before the Public Enquiry to be held in January.

It was RESOLVED that a further report, clarifying the situation, should be presented to Cabinet as soon as possible.

Reason for decision: to enable improvements to be carried out at the Council’s premises.

Consideration was given to the Report of the Director of Highways, Property and Works updating Members in relation to the feasibility for development of the site at 64, Heol Dinas, Penparcau, Aberystwyth.

DECISION

To authorise the sale of the land subject to agreement as to terms and conditions.

Reason for decision:- taking into account planning considerations.

Ystyriwyd Adroddiad Cyfarwyddwr y Priffyrdd, Eiddo a Gwaith ar y gofynion newydd ar iechyd a diogelwch mewn mynwentydd a thir claddu

PENDERFYNIAD

(i) yn amodol ar ymgynghori gyda threfnwyr angladdau, seiri meini coffa a grwpiau perthnasol eraill, ni ddylid claddu ym Mynwent Ffordd Llanbadarn o’r 1af o Ionawr 2005 ymlaen neu cyn gynted ag y bydd y broses gyfreithiol yn caniatáu;

(ii)y dylid cymryd camau er mwyn sicrhau y bydd y tir yng Nghefnllan yn addas i’w ddefnyddio o’r 1af o Ionawr 2005 ymlaen, gan gynnwys darparu cyflenwad d r a chysgodfa bren seml. Bydd hyn yn costio £10,000 a ddaw o’r Rhaglen Gyfalaf;

(iii) y dylid arddangos arwyddion priodol yn y fynwent er mwyn hysbysu’r

cyhoedd o’r camau hyn yn ogystal â hysbysiad yn y wasg

(iv) y dylid ffurfioli’r broses o wirio diogelwch a systemau rheoli, fel yr amlinellir yn Atodiad A yr Adroddiad, ac y dylid gofyn i Uned Iechyd a Diogelwch y Cyngor gadarnhau fod y dulliau gweithredu a’r camau a gymerir yn ddigonol;

(v) sicrhau y caiff pwyntiau 3 a 4 Atodiad A eu cyfnewid, a hynny er mwyn sicrhau bod teuluoedd yn ymwybodol o’r drefn;

(vi) cyflwyno adroddiad arall i’r Cabinet parthed cynnal a chadw meini coffa newydd, a hynny yn hytrach na chynnig prydles;

(vii) y dylid cynnwys swm wrth gefn dros dro yn y Rhaglen Gyfalaf er mwyn gweithredu hyn;

(viii) y dylid cynyddu ffioedd claddu fel yr amlinellir yn Atodiad B yr Adroddiad, dylai hyn ddod i rym ar y 1af o Ebrill 2005;

(ix) y dylid trosglwyddo’r cyfrifoldeb dros weinyddu claddedigaethau a chofrestru cofebion, gan gynnwys ceisiadau, archwiliadau, gwirio diogelwch a strwythur, cofnodion a ffioedd, yn ffurfiol o Adran y Gwasanaethau Cyfreithiol a Chorfforaethol i’r Adran Briffyrdd, Eiddo a Gwaith, ac o ganlyniad, byddai’r dyletswyddau o gymeradwyo ceisiadau, gwirio diogelwch a strwythur, cofnodion ac agor beddau dan ofalaeth yr un adran. Gall hyn leihau’r posibiliad o wneud camgymeriadau. Fe fydd staff Swyddfa Leol Aberteifi yn parhau i dderbyn ceisiadau, fel a ddigwydd ar hyn o bryd; a

(x) awdurdodi creu swydd cyfnod sefydlog hunan-gyllido am ddwy flynedd a ariennir yn rhannol gan incwm rheoli adeiladu a’n rhannol gan incwm o ffioedd claddu ac y dylid penodi yn awr at y dibenion hyn.

Health and Safety in Cemeteries and Burial Grounds

Consideration was given to the Report of the Director of Highways, Property and Works upon new requirements in relation to health and safety in cemeteries and burial grounds.

DECISION

(i) that, subject to consultations with funeral directors, monumental masons and other concerned parties, no new burials take place at the Llanbadarn Road Cemetery as from 1 January 2005 or as soon as legal procedures allow;

(ii) that steps be taken to bring the land at Cefnllan into use as a cemetery as from 1 January 2005, including the provision of a water supply and a simple timber shelter, at a cost of £10,000 to be met from the Capital Programme;

(iii) that appropriate signage be displayed at the cemetery in order to advise the public of this action together with a press notice

(iv) that safety check and control systems are formalised, as set out in Appendix A of the Report, and that the Council’s Health and Safety Unit be asked to certify the adequacy of the procedures and action being taken;

(v) to ensure that points 3 and 4 of Appendix A are swapped in order to ascertain that families are aware of the procedure;

(vi) that a further report be presented to Cabinet in relation to the upkeep of new memorials as an alternative to the granting of a lease;

(vii) that a provisional contingency of £15,000 be included in the Capital Programme for implementing this work;

(viii) that burial fees be increased as set out in Appendix B of the Report with effect from 1 April 2005;

(ix) that responsibility for the administration of burials and the registration of memorials including applications, inspections, safety and structural checks, records and fees be now formally transferred from DCLS to DHPW, thereby ensuring that approval of applications, safety and structural checks, records, and the opening of graves would be in the same department and reduce the possibility of mistakes. Cardigan LDO staff would continue to receive applications as at present; and

(x) to authorise a self funding fixed term post for two years funded partly by building control income and partly by burial fee income be created and filled now for these purposes.

Reason for decision:- in order to ensure that all recommended actions are being implemented.

Ceredigion Library Service – recent developments and impending risk

Consideration was given to the Report of the Director of Education and Community Services upon the recent developments and impending risks in relation to the Ceredigion Library Service.

DECISION

(i) to note the content of the Report and the risks to the service; and

(ii) noting that the department would be requesting a budget growth item of £50,000 for 2005/06 to cover the loss of current grant funding, in order to maintain the service at its current level.

Reason for decision:- in order to raise awareness of the funding required if the Branch Libraries are to be maintained at their current level.

Feedback on the Cambridge Education Associates Consultation

Consideration was given to the Report of the Director of Education and Community Services updating Members on an Advisory Study by Cambridge Education Associates in relation to the costs of providing SEN services in Ceredigion.

DECISION

(i) to note the content of the Report; and

(ii)to accept the findings and recommendations of Cambridge Education Associates in relation to SEN services in Ceredigion.

Reason for decision:- to ensure the good provision of SEN services within the County.

Third Review of Ambient Air Quality in Ceredigion

DECISION

To note the content of the Report and the information in relation to air quality in Ceredigion and endorse the programme of ambient air quality monitoring in the County.

Reason for decision:- to comply with the Authority’s statutory duties in relation to the monitoring of ambient air quality in the County, the requirement to review monitoring results and to report and publish findings.

Local Authority Responsibilities under the Gambling Bill

DECISION

(i) to support, in principle, the objectives of the Gambling Bill;

(ii) t agree to participate in the consultation exercise that the Department of Culture, Media and Sport proposes to embark upon regarding the estimated costs of the premises licensing process; and

(iii) to delegate authority to officers to respond to the WLGA.

Reason for decision:- to assess and monitor the impact that the Gambling Bill will have on businesses and residents in Ceredigion.

Ceredigion Statement of Licensing Policy

DECISION

(i) to note the content of the Report and recommend to full Council that the Ceredigion Statement of Licensing Policy is adopted and published;

(ii) to request that a further report be presented to Cabinet clarifying the licensing requirements for village halls in varying activities e.g. eisteddfodau, dances etc.; and

(iii) to note that a Report upon the cost implication of implementing the requirements of the Licensing Act 2003 will be presented to Cabinet.

Reason for decision:- in order to assist the Council in discharging its statutory duties under the Licensing Act 2003.

Door Supervisors

DECISION

(i) to redefine the terms “Door Supervisors Course” and “Registered Door Person” within the Council’s Standard Licensing Conditions produced in accordance with paragraph 11(1) of Schedule 1 of the Local Government (Miscellaneous Provisions) Act 1982;

(ii) to require that Door Supervisors will be provided at premises and in circumstances as highlighted in paragraphs a),b) and c) of the report; and

(iii) to recommend accordingly to Council.

Reasons for decisions:-To ensure that supervisory arrangements at premises in Ceredigion that provide Public Entertainment compliment the requirements and expectations of the Private Security Industry Act 2001.

PENDERFYNIAD

(i) bod y Cabinet yn nodi cynnwys yr adroddiad a’r ymdrechion trylwyr a wnaethpwyd gan Gyfarwyddwr y Gwasanaethau Cymdeithasol a Chyfarwyddwr y Gwasanaethau Corfforaethol a Chyfreithiol yn cynorthwyo CAMFA i archwilio cwynion a datblygu cytundeb gwasanaeth a addaswyd;

(ii) Bod y Cabinet yn cymeradwyo argymhelliad y swyddogion bod CAMFA i gael un cyfle terfynol drwy ofyn iddynt gydweithio ar unwaith ac yn llawn er mwyn archwilio cwynion;

(iii) os bydd CAMFA yn methu â chydymffurfio gyda (ii) uchod erbyn 30 Tachwedd 2004 bod eu gwasanaethau fel darparwyr ‘Cefnogi Pobl’ yn dod i ben heb gyfnod rhybudd ac y dylid cael darparwr arall ar gyfer cleientiaid a gefnogir ar hyn o bryd; ac

(iv) yn achos gorfod gweithredu (iii) uchod, bydd Cyfarwyddwr y Gwasanaethau Cymdeithasol a Chyfarwyddwr y Gwasanaethau Corfforaethol a Chyfreithiol yn rhoi ystyriaeth bellach i Gytundeb Lefel Gwasanaeth yr Awdurdod gyda CAMFA mewn perthynas â gweithredu Canolfan Alw i Mewn.

Rheswm dros y penderfyniad:- er mwyn sicrhau bod pryderon a all godi yn cael eu delio â hwy mewn dull priodol.

CAMFA

Consideration was given to the Report of the Director of Social Services updating Members in relation to the current situation in relation to complaint investigations.

DECISION

(i) that Cabinet note the contents of the report and the exhaustive attempts made by the Director of Social Services and the Director of Corporate and Legal Services in assisting CAMFA with regards to the investigation of complaints and developing a modified service agreement;

(ii) That Cabinet endorse the recommendation of officers that CAMFA be given one final opportunity by being required to cooperate immediately and fully in relation to the investigation of complaints;

(iii) that if CAMFA fail to comply with (ii) above by 30 November 2004 that their services as ‘Supporting People’ provider be discontinued without a period of notice and that an alternative provider be sought for the clients currently supported; and

(iv) that, in the event of (iii) above having to be actioned, the Director of Social Services and Director of Corporate and Legal Services give further consideration to the Authority’s SLA with CAMFA in relation to the operation of a drop-in centre.

Reason for decision:- in order to ascertain that concerns which arise are dealt with in a proper manner.

Consideration was given to the Report of the Director of Corporate and Legal Services requesting support towards and Objective 1 application.

DECISION

To authorise the submission of a letter of support in principle towards the project subject to the following conditions:

• The County Council should be consulted formally on the draft business plans of eachMenter Organisation and other community group
• The local County Councillors should be invited to attend as nominees or observers on the Menter Groups or community groups
• The Menter Organisation and community groups funded by the project should be required to participate in joint working activity with the County Council and the WDA eg Ceredigion 2020, Stronger Communities Thematic Partnership.

Reason for decision:- to support in principle

Croesawodd y Cadeirydd Meistri Keen a Parker o Richard Keen Associates i’r Cyfarfod er mwyn gwneud cyflwyniad ar eu argymhellion ar gyfer adfer a defnyddio Castell Aberteifi yn y dyfodol.

Yn dilyn cwestiynau o’r llawr, diolchodd y Cadeirydd iddynt am eu cyflwyniad gan fynegi eu siom mai dim ond un dewis a amlinellwyd.

Cardigan Castle

The Chairman welcomed Messrs Keen and Parker from Richard Keen Associates to the Meeting to make a presentation on their proposals for the restoration and future usage of Cardigan Castle.

Following questions from the floor, the Chairman thanked them for their presentation and expressed his disappointment that only one option was outlined.

DECISION

(i) that a further report be presented to Cabinet outlining all available options by the end of January 2005; and

(ii) to authorise the appointment of a Project Officer in accordance with the Council’s successful “Unlocking the Potential” bid and its contract with WEFO.

Reason for decision:- to ensure that all available options are given due consideration in relation to Cardigan Castle.
